During August 2016, the ASA considered, and ruled against internet advertising featured on the website www.adoringdress.co.za
The advertising offered various wedding dresses and party dresses for sale at specified prices. However, the fact that these dresses were all imported, and would attract customs duties was not highlighted in the advertising. The complainant took issue with this, arguing that the advertising was misleading.
All reasonable steps were taken by the ASA to elicit a response from the advertiser, but the advertiser failed to respond. Therefore, the Directorate had no option but to rule based on the information at hand.
The ASA ruled that the advertising was in contravention of Clause 4.2.1 of Section II of the Code, as it failed to alert customers that additional costs in the form of import taxes would be incurred by the purchaser.
Members are therefore requested not to accept advertising from "Adoring Dress” that does not pertinently mention this fact.
